Shallow Rights Reversion on the way in Alberta

It was the early 1980s that Alberta Energy severed PNG rights below the base of the deepest productive formation in all continued leases, returning those deep rights back to the land bank for future purchase at Land Sales. In 2008, Alberta Energy determined that for any new PNG agreements purchased after January 1, 2009, both shallow rights and deep rights would revert at the end of the primary term when/if continuation was granted. It also considered issuing shallow rights reversion (SRR) notices for PNG agreements issued prior to January 1, 2009, however, over the next number of years the decision was made to “place a hold” on serving those SRR notices. That decision has now been reversed and this Information Letter was issued on April 22, 2025.  This will be discussed at the April 30, 2025, Tenure Industry Advisory Committee (TIAC) meeting.
